Title IX
Title IX of the Education Amendments of 1972 and its implementing regulations prohibit specific forms of sexual harassment.
The Title IX applies to sexual harassment that occurs in the following circumstances:
- While an individual (including a student, faculty member, or staff member) was participating in or attempting to participate in an Elon University educational program or activity, which includes:
- Any on-campus premises;
- Locations, events, or circumstances, on-campus or off-campus over which Elon University exercises substantial control over both the respondent and the context in which the conduct occurs; or
- Any building owned or controlled by a student organization that is officially recognized by Elon University; and
- Against a person who is located in the U.S.
Conduct which meets these requirements, and which would meet the definition of prohibited sexual harassment under Title IX, as described herein, will be addressed through the Title IX Process and Procedures section of this policy.
Sexual Misconduct
Students
Reports of prohibited sexual misconduct allegedly perpetuated by a student that alleges behavior outside of the scope of the definition of Title IX sexual harassment will be addressed through the Sexual Misconduct Process and Procedures section of this policy.
Note: Conduct which violates any other university policy may fall under this policy when it is allegedly motivated by actual or perceived bias sex or gender.
Faculty
Reports of sexual misconduct allegedly perpetuated by faculty that allege behavior outside the scope of the definition of Title IX sexual harassment will be addressed through the Faculty Grievance for Discrimination and Harassment process outlined in the Faculty Handbook.
Staff
Reports of sexual misconduct allegedly perpetuated by staff that allege behavior outside the scope of Title IX sexual harassment will addressed through the appropriate grievance procedures in the Staff Manual.
Where reports outside the scope of the definition of Title IX sexual harassment are made involving an individual with multiple roles at the university (i.e. combination of faculty, staff, or student), the Title IX Coordinator will determine which policy and process apply in conjunction with the Associate Vice President for Human Resources and communicate the decision with the appropriate parties.
